1. Acceptance of Terms

By accessing or using TrackSub ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

TrackSub is a subscription tracking and management platform that helps you monitor recurring payments, receive renewal reminders, and analyze your subscription spending. The Service is provided free of charge and is available on web and mobile platforms.

3. User Accounts

To use TrackSub, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

4. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not attempt to hack, disrupt, or damage the Service
• Not upload malicious code or viruses
• Respect the intellectual property rights of TrackSub
• Not use the Service to store or transmit illegal content

5. Data Accuracy

While TrackSub helps you track subscriptions, you are responsible for entering accurate information. We are not liable for missed payments or renewals resulting from incorrect data entry. The Service provides reminders as a convenience and does not guarantee notification delivery.

6. Intellectual Property

The Service, including its design, features, and content, is owned by TrackSub and protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Limitation of Liability

TrackSub is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to missed payments, data loss, or financial losses. Our total liability shall not exceed the amount you paid for the Service (currently $0).

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

9. Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms of Service. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

13. Apple App Store Terms

If you downloaded TrackSub from the Apple App Store, the following terms apply:

• Acknowledgement: This agreement is between you and TrackSub only, not Apple. TrackSub is solely responsible for the Licensed Application and the content thereof.
• Scope of License: The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: TrackSub is solely responsible for providing any maintenance and support services with respect to the Licensed Application. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
• Warranty: TrackSub is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.
• Product Claims: TrackSub, not Apple, is responsible for addressing any claims of you or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Rights: In the event of any third party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party’s intellectual property rights, TrackSub, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using the Licensed Application.
• Third Party Beneficiary: Apple, and Apple’s subsidiaries, are third party beneficiaries of this agreement. Upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third party beneficiary thereof.
